Terms
What each side promises, in words you can hold us to.
The agreement
These terms, our privacy notice, our data processing terms, our availability commitment and any order we both sign make up the whole agreement. Where an order we have both signed says something different, the order wins.
The agreement starts when a company first uses FLO or signs an order, whichever is earlier. The person accepting it confirms they may bind their company.
Your account
A company names administrators, who add and remove their own people. What those administrators and people do is the company's responsibility, so keep the list current and take access away when somebody leaves.
We sign people in with passkeys rather than passwords. A company may require them, which closes the weaker ways in once a person holds one. Keeping recovery details accurate is the company's job; without them a locked out person needs an administrator.
What it costs
| Item | Terms |
|---|---|
| Price | US$5 per person a month billed yearly, or US$6 billed monthly. In US dollars, billed in advance for the year or the month |
| Storage | 30 GB per person in one pool the whole company shares across mail, Cloud, Chat files and recordings |
| Storage packs | 100 GB US$4 a month or US$48 a year; 1 TB US$30 a month or US$360 a year; 2 TB US$55 a month or US$660 a year. Any number of each, billed with the plan on its interval. A pack added or removed part way through a period is charged or credited for the part left |
| Trial | 14 days, set up by our team after a call. No card needed |
| Seats | Counted nightly from the people who can sign in. Suspended people do not count |
| Changes | Adding a person is charged from the next invoice. Removing one reduces the next invoice |
| Tax | Prices exclude GST and any other tax, which is added where the law requires it |
| Late payment | Reminders on days 1, 7 and 13 overdue. From day 14 the account is read only: reading, search and export work, new mail, uploads and recordings pause. We may suspend after thirty days overdue. Nothing is deleted |
Invoices are payable within fourteen days. We do not refund part of a month or a year for seats, though we do credit a month we failed to keep available, on the terms of the availability commitment.
Your content is yours
Everything a company and its people put into FLO stays theirs. We claim no ownership of it and no licence beyond what running the service needs: storing it, delivering it, indexing it so it can be searched, checking it for phishing and malicious content, then showing it back to the people entitled to see it.
We do not sell it, we do not use it for advertising, we do not train any model on it. Where a company turns on the parts of FLO IQ that use an external model, that content goes with names and addresses replaced by tokens, under retention switched off on the provider's side.
A company may export its mail, files, calendars and contacts at any time in standard formats, during the agreement and for thirty days after it ends.
What we promise
We will run the service with reasonable skill and care, keep it available on the terms of the availability commitment, protect content as the security page describes, then process personal information as the data processing terms set out.
Beyond those, the service is provided as it is. We do not promise it is free of every fault, nor that it suits a purpose we have not discussed. Nothing here excludes a right that cannot lawfully be excluded, including the consumer guarantees under Australian law.
How it may be used
A company and its people will not use FLO to:
- break the law, or help somebody else break it
- send unsolicited bulk mail, or mail to addresses collected without consent
- send or store material that is unlawful, or that infringes somebody else's rights
- carry malicious code, or run an attack against anybody
- get around a limit, a quota or a security measure
- resell the service, or open it to people outside the company without our agreement
A company is responsible for what its people send. Where we must act to protect other customers or the reputation of the service, we act, then we say why.
Sending mail
A mail service lives or dies by whether its messages arrive, which depends on the behaviour of everybody sending through it. So there are limits, none of them negotiable: no unsolicited bulk sending, honour every unsubscribe request, keep lists clean, never send to an address that has hard bounced.
We may rate limit, hold or refuse mail that threatens delivery for other customers. Where an account is compromised and sending on somebody else's behalf, we will stop it first and tell the administrators immediately after.
Services you connect
A company may connect other services, such as a calendar at another provider, a payment provider for its booking pages or an application signing in through FLO. Those services are run by other people under their own terms. What they do with information a company sends them is between the company and them.
Suspension
We may suspend an account, or a part of one, where there is a real risk to the service or to other customers, where the law requires it, or where an invoice is more than thirty days overdue. We tell the administrators before suspending unless the risk makes that impossible, then restore as soon as the reason has gone.
Before that, an account with an invoice fourteen days overdue becomes read only until it is paid. People can still sign in, read, search and export everything; sending new mail, uploading files and starting recordings pause. Paying restores full use at once.
Ending it
A company may end the agreement at any time, effective at the end of the month it has paid for. We may end it with thirty days' notice, or immediately where the terms are breached seriously without the breach being put right within fourteen days of being told.
When it ends, content can be exported for thirty days. After that the company's key is destroyed, which makes every copy unreadable, including the ones in backups. That is final, so export first.
Liability
Neither side is liable for indirect loss, loss of profit, or loss of goodwill. Each side's total liability in any twelve month period is limited to the fees paid in that period.
Those limits do not apply to a failure to pay, to a breach of confidentiality, to a wilful breach, nor to anything that cannot lawfully be limited. A company indemnifies us against claims arising from content it put into the service or from use that breaks these terms.
Changes
We improve the service continuously, which sometimes changes how a feature works. We do not remove a feature a company relies on without thirty days' notice.
We may change these terms with thirty days' notice to the administrators. A company that does not accept a change may end the agreement before it takes effect, with a refund of anything paid for time it will not use.
Law and disputes
This agreement is governed by the law of New South Wales, Australia, where both sides submit to the courts.
Before either side goes to court, we will each put the problem in writing and give the other thirty days to fix it. Nothing stops either side from seeking an urgent order from a court where it is genuinely needed.
